Who does this notice apply to?
Us. We are Dwyer (UK Franchising) Limited, Dream Doors Limited, Bright & Beautiful UK Limited, Countrywide Garden Maintenance Services Limited, Greensleeves Garden Care Limited and Pimlico Plumbers Limited (together “we” or “us“) and we are part of a group of companies owned by Dwyer Franchising LLC based in Texas, U.S.A (“Neighborly“).
You. This Privacy Notice tells you how we will process your personal data when you apply for a position with us. It also describes your data protection rights, including a right to object to some of the processing which we carry out. More information about your rights, and how to exercise them, is set out in the Your Choices and Rights section.
We may also provide you with additional information when we collect personal data, where we feel it would be helpful to provide relevant and timely information.
Not Our Franchisees. Our franchisees are independent business owners and each franchisee is responsible for its own data protection compliance. If you are applying for a position with a franchisee using a website that is operated by us or in our name, we will pass on your application and data to the relevant franchisee and they will be in touch with you. That franchisee will be responsible (the ‘data controller’) for that personal data, and if you have any questions about how that franchisee uses your data you should contact them directly.
What personal data we collect
As part of our recruitment process and in order to progress your application we process the following types of personal data when you apply for a position with us:
- Contact & identification information: such as your name, address, phone, email, gender, date of birth, home address, personal email address, personal phone number, nationality and eligibility to work.
- Credentials & experience: such as your CV, employment history, educational background, achievements, career trajectory and interests.
- Application information: (where necessary for your role with us) psychometric testing records and background record checks (including criminal convictions checks).
- IT information: if you submit an application through our online portal, we may collect information sent to us by your computer, mobile phone or other access device. For example, this includes the pages you access, your computer IP address, device identifiers, the type of operating system you are using, your location, mobile network information, standard web log data and other information, and your browser type and traffic to and from our site.
- Any other information you submit to us (including during the course of any correspondence you may have with us): such as signatures, photographs, opinions, your location and any other information you provide.
On occasion, we receive certain types of personal data from third party sources, such as those listed below:
- Details of certifications, training qualifications or results you have obtained from the relevant course provider.
- Feedback concerning your performance and referrals from former employers.
- Information you have submitted to us through a third-party recruitment website.
- Results of any checks from the Home Office Disclosure and Barring Service (DBS) (only where necessary for your role).
Why we collect, use and store this personal data
We collect, use and store your personal data for the reasons set out below.
- Where this is necessary for us to review and assess your application for employment.
- This includes assessing your skills and interest in career opportunities with us, progressing your application, analyzing your qualifications, verifying your identity and your eligibility for employment, and communication with you about your application to respond to your inquiries and schedule interviews.
- Where necessary to comply with a legal obligation.
- Disclosures to law enforcement agencies or in connection with legal claims, health & safety compliance and regulatory purposes (including disclosure of such information in connection with legal process or litigation).
- Where necessary for our legitimate interests, as listed below, and where our interests are not overridden by your data protection rights.
- Protecting our legitimate business interests and legal rights. This includes, but is not limited to, use in connection with legal claims, compliance, regulatory, auditing, and other ethics and compliance reporting requirements.
- Maintaining the security and integrity of our facilities, equipment and electronic platforms. This includes administering access rights, monitoring compliance with company protocols.
- Where you have given consent.
- We may use your personal data for purposes other than those described here where we request, and you provide, your specific and informed consent.
How we share your personal data
We may share your information concerning your application with other members of Neighborly in order to consider your candidacy for other relevant open positions.
Your personal data will also be shared with companies providing services under contract to us, such as software and IT systems providers and other IT hosting and/or IT maintenance providers.
Personal data will also be shared with government authorities and/or law enforcement officials if required for the purposes above, if mandated by law or if required for the protection of our legitimate interests in compliance with applicable laws.
In the event that part of our business is sold or integrated with another business (in part or whole), your details may be disclosed to our advisers and any prospective purchaser’s adviser and will be passed to the new owners of the business / business unit. Likewise, we may share your personal data if we outsource a function related to your employment.
Your choices and rights
You have the right to ask us for a copy of your personal data; to correct, delete or restrict processing of your personal data; and to obtain the personal data you provide in a structured, machine readable format. In addition, you can object to the processing of your personal data in some circumstances (in particular, where we don’t have to process the data to meet a contractual or other legal requirement or compelling interest). Where we have asked for your consent, you may withdraw consent at any time. If you ask to withdraw your consent to us processing your data, this will not affect any processing which has already taken place at that time.
These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep. If you have unresolved concerns, you have the right to complain to the data protection authority in the country you reside, where you work or where we are located.
We will retain your personal data only for the duration of the recruitment process and, if you are unsuccessful or choose not to accept an employment offer, for a short period of 9 months. After such period we will take steps to delete your personal data or hold it in a form that no longer identifies you. If you accept employment with us, we will retain your personal data throughout your employment in accordance with a separate notice we provide to you upon acceptance of your employment.
International transfers
Some of the service providers with whom we share your personal data also access personal data in the United States and other countries that do not have equivalent data protection laws to the European Economic Area (“EEA“). Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
- We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
- Or we use standard contracts or binding corporate rules or code of conduct or other approved mechanisms recognised by the Information Commissioner’s Office.
